Acceptance

Your access to and use of the Site is subject to these Terms of Use and all applicable laws and regulations. By accessing and browsing the Site, you accept, without limitation or qualification these Terms of Use and acknowledge that these Terms of Use constitute the entire agreement between you and Diaverum regarding your use of the Site, and supersedes any prior agreements in relation to your use of the Site. You represent that you have not accepted the Terms of Use in reliance on any oral or written representations made by us that are not contained herein.

Diaverum reserves the right to amend these Terms of Use from time to time without notice. The date of last modification is stated at the end of these Terms of Use. It is your responsibility to check the Site from time to time for updates. When we make revisions of these Terms of Use which we consider material, we will inform you by way of a notification on the Site. Your use of the Site after such change is implemented constitutes your acknowledgement and acceptance of the change. If you do not agree with these Terms of Use, please do not use the Site.

Use of Site

Unless otherwise expressly set out on the Site, all materials, including but not limited to images, illustrations, icons, photographs, technologies, documents, software and services that are part of the Site (collectively the “Materials”) are copyrights, trademarks and/or other intellectual property rights owned by, controlled by or licensed to Diaverum or its affiliated parties. Except as expressly authorized by us, you may not modify, copy, reproduce, republish, transmit, distribute, sell, license, rent, publicly display or perform, edit or adapt, in any manner any Materials.

Notwithstanding the aforesaid, you may print or download Materials from the Site solely for personal and non-commercial use, provided that you do not republish or distribute such Material in any way and that you keep intact all copyright, trademark and other intellectual property notices. Diaverum neither warrants nor represents that your use of Materials displayed on the Site will not infringe rights of third parties not owned by or affiliated with Diaverum.

Use of Materials from the Site for any purpose or in any way not expressly permitted in these Terms of Use or otherwise expressly authorized by us is prohibited.
We expect you to respect the integrity of the Site, and you are, for example, not permitted to (i) introduce malicious content such as malware, Trojan horses or viruses, or content which otherwise interferes with the Site; (ii) artificially manipulate the Site by using scripts, bots, plugins, extensions or other automated processes; (iii) interfere with the Site by tampering with, attempting to probe or testing the vulnerability of the Site; or (iv) otherwise utilize the Site in a way which conflicts with these Terms of Use.

Product information on the Site is provided by Diaverum and is intended for general information purposes only. Accordingly, no such information shall be construed as medical or other professional advice. Many pharmaceutical and medical device products listed are available upon prescription from a physician or qualified medical professional only, and not all such products may be available in all countries. Should you have a medical condition, promptly see your own medical doctor or health care provider, as we do not offer personalized medical diagnosis or patient-specific treatment advice. Postings to the Site

Diaverum may choose to provide visitors of the Site the opportunity to take part in discussions, chats, transmissions, bulletin boards and similar forums on the Site. You are prohibited from posting or transmitting any offensive, harmful, inaccurate or otherwise inappropriate content (the “Prohibited Content”) in such forums. Diaverum cannot monitor or control content and information provided by visitors in such forums, and takes no responsibility or liability for any Prohibited Content provided by visitors of the Site. However, we strive to take down any Prohibited Content on the Site of which we are notified as soon as possible. For this reason, we encourage you to report any content on the Site which is illegal, offensive, abusive or otherwise not in line with these Terms of Use to us. Diaverum will also fully cooperate with any law enforcement authorities or court order requesting or directing Diaverum to disclose the identity of anyone posting any Prohibited Content.

Consequences

If we become aware that you have violated any of the terms and conditions contained in these Terms of Use, we may immediately take corrective action, including preventing you from using the services offered by Diaverum and removing any content put on the Site by you, at any moment and without notice. If we have been injured by your violation we may, in our sole discretion, seek to recover damages from you.

Waiver and Severability

Any provisions, disclaimers and limitations of liability in these Terms of Use apply to the maximum extent permitted under applicable law. Your jurisdiction may not allow certain disclaimers of warranties or certain limitations of liability, and as a result certain of the contents of the Terms of Use (including the section “Limitation of Liability”) may not apply to you. The failure to enforce any terms and conditions of these Terms of Use by Diaverum shall not be deemed a waiver of such term or condition.

Should any provision of these Terms of Use be held to be unlawful, invalid or unenforceable, such provision(s) shall not render invalid or unenforceable the remaining provisions of these Terms of Use, which will remain in full force and effect, and the application of that provision shall be enforced to the extent permitted by law.

Applicable law and jurisdiction

Unless otherwise required by a mandatory law of your jurisdiction, these Terms of Use are subject to the laws of Sweden, without regard to choice- or conflicts of law principles, and you and Diaverum agree to the exclusive jurisdiction of the courts of Sweden to resolve any dispute, claim or controversy that arises in connection with these Terms of Use.
